These Class Hud Terms and Conditions (the "Terms") constitute a legally binding agreement between the company Classhud PVT. LTD. and a GST number (the "Company", "we", "us", and "our") and an individual user or a business entity (the "user") accessing and using the software-as-a-service Class Hud available at https://www.classhud.com, the mobile applications Class HUD, and the related services and products (collectively, "Class hud"). Disclaimer : All information provided on Class Hud is for general information purposes only; it does not constitute technical or expert advice. Although we regularly monitor Class Hud, we cannot guarantee the accuracy, reliability, relevance, and completeness of the information available on Class Hud, neither provided by us nor by the users of Class Hud. Third-party links and advertising : Class Hud may contain links to websites, applications, and other online sources owned and operated by third parties. Class Hud may also feature information provided by the Organizations, teachers, students, parents, and other third parties. We are not responsible or liable in any manner for the content of such third-party links, information, as well as the security and privacy practices deployed by the operators of third-party websites. YOUR ACCEPTANCE OF THIS AGREEMENT: This is an agreement between you ("you" or "your") and Class Hud Pvt. Ltd., ("Class Hud" "we," or "our") that governs your use of the search services offered by Class Hud through its website www.Classhud.com ("Website"), or any other medium using which Class Hud may provide the search services (collectively "Platforms" ). When you access or use any of the Platforms you agree to be bound by these Terms and Conditions ("Terms"). CHANGES: We may periodically change the Terms and the Site without notice, and you are responsible for checking these Terms periodically for revisions. All amended Terms become effective upon our posting to the Site, and any use of the site after such revisions have been posted signifies your consent to the changes. HOW YOU MAY USE OUR MATERIALS: We use a diverse range of information, text, photographs, designs, graphics, images, sound and video recordings, animation, content, advertisement and other materials and effects (collectively "Materials") for the search services on the Platforms. We provide the Material through the Platforms FOR YOUR PERSONAL AND NON-COMMERCIAL USE ONLY. While every attempt has been made to ascertain the authenticity of the Platforms content, Class Hud is not liable for any kind of damages, losses or action arising directly or indirectly, due to access and/or use of the content in the Platforms including but not limited to decisions based on the content in the Platforms which results in any loss of data, revenue, profits, property, infection by viruses etc. Accordingly, you may view, use, copy, and distribute the Materials found on the Platforms for internal, non-commercial, informational purposes only. You are prohibited from data mining, scraping, crawling, or using any process or processes that send automated queries to Class Hud.. You may not use the Platforms or any of them to compile a collection of listings, including a competing listing product or service. You may not use the Platforms or any Materials for any unsolicited commercial e-mail. Except as authorized in this paragraph, you are not being granted a license under any copyright, trademark, patent or other intellectual property right in the Materials or the products, services, processes or technology described therein. All such rights are retained by Class Hud, its subsidiaries, parent companies, and/or any third party owner of such rights. HOW WE MAY USE INFORMATION YOU PROVIDE TO US: Do not send us any confidential or proprietary information. Except for any personally identifiable information that we agree to keep confidential as provided in our Privacy Policy, any material, including, but not limited to any feedback, data, answers, questions, comments, suggestions, ideas or the like, which you send to us will be treated as being non-confidential and nonproprietary. We assume no obligation to protect confidential or proprietary information (other than personally identifiable information) from disclosure and will be free to reproduce, use, and distribute the information to others without restriction. We will also be free to use any ideas, concepts, know-how or techniques contained in information that you send us for any purpose whatsoever including but not limited to developing, manufacturing and marketing products and services incorporating such information.REVIEWS, RATINGS & COMMENTS BY USERS:
Since, Class Hud provides information directory services through various mediums ( E-Mail, Website, APP and voice or phone), your ("Users") use any of the aforementioned medium to post Reviews, Ratings and Comments about the Class Hud services and also about the Advertiser's listed at Class Hud is subject to additional terms and conditions as mentioned herein. You are solely responsible for the content of any transmissions you make to the Site or any transmissions you make to any mediums offered by Class Hud and any materials you add to the Site or add to any mediums offered by Class Hud, including but not limited to transmissions like your Reviews, Ratings & Comments posted by you(the "Communications"). Class Hud does not endorse or accept any of your Communication as representative of their (Class Hud) views. By transmitting any public Communication to the Site, you grant Class Hud an irrevocable, non-exclusive, worldwide, perpetual, unrestricted, royalty-free license (with the right to sublicense) to use, reproduce, distribute, publicly display, publicly perform, adapt, modify, edit, create derivative works from, incorporate into one or more compilations and reproduce and distribute such compilations, and otherwise exploit such Communications, in all Platforms now known or later developed. You confirm and warrant that you have the right to grant these rights to Class Hud . You hereby waive and grant to Class Hud all rights including intellectual property rights and also "moral rights" in your Communications, posted at Class Hud through any of mediums of Class Hud. Class Hud is free to use all your Communications as per its requirements from time to time. You represent and warrant that you own or otherwise control all of the rights to the content that you post as Review, Rating or Comments; that the content is accurate; that use of the content you supply does not violate these Terms and will not cause injury to any person or entity. For removal of doubts it is clarified that, the reference to Communications would also mean to include the reviews, ratings and comments posted by your Friend's tagged by you. Also Class Hud reserves the right to mask or unmask your identity in respect of your Reviews, Ratings & Comments posted by you. Class Hud has the right, but not the obligation to monitor and edit or remove any content posted by you as Review, Rating or Comments. Class Hud cannot review all Communications made on and through any of the mediums of Class Hud. However, Class Hud reserves the right, but has no obligation, to monitor and edit, modify or delete any Communications (or portions thereof) which Class Hud in its sole discretion deems inappropriate, offensive or contrary to any Class Hud policy, or that violate this terms: Class Hud reserves the right not to upload or distribute to, or otherwise publish through the Site or Forums any Communication which- is obscene, indecent, pornographic, profane, sexually explicit, threatening, or abusive;
- constitutes or contains false or misleading indications of origin or statements of fact;
- slanders, libels, defames, disparages, or otherwise violates the legal rights of any third party;
- causes injury of any kind to any person or entity;
- infringes or violates the intellectual property rights (including copyright, patent and trademark rights), contract rights, trade secrets, privacy or publicity rights or any other rights of any third party;
- violates any applicable laws, rules, or regulations;
- contains software viruses or any other malicious code designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
- impersonates another person or entity, or that collects or uses any information about Site visitors.

While every attempt has been made to ascertain the authenticity of the content on the Platforms Class Hud has no control over content, the accuracy of such content, integrity or quality of such content and the information on our pages, and material on the Platforms may include technical inaccuracies or typographical errors, and we make no guarantees, nor can we be responsible for any such information, including its authenticity, currency, content, quality, copyright compliance or legality, or any other intellectual property rights compliance, or any resulting loss or damage. When using Class Hud, the user is required to follow our acceptable use policy. We work closely with law enforcement and we report any inappropriate content that may infringe applicable laws. The user is not permitted to use Class Hud in any manner that substitutes or contributes to the following activities (the list is representative and not exhaustive):- Any unlawful activity, including violation of any laws, statutes, ordinances, or regulations;
- Fraud;
- Provision of false, inaccurate, or misleading information;
- Dissemination of information about the acts, including pranks and challenges, that may result in injuries and physical harm;
- Posting of the Records that depict or incite others to commit acts of violence;
- Provision of the Records that depict children or may cause emotional distress to children;
- Gambling, including contests, lotteries, games of chance, bidding fee auctions, sports forecasting or odds making, Internet gaming, fantasy sports leagues with cash prizes, and sweepstakes;
- Spreading of malware (e.g., viruses, worms, Trojan horses), spam, and other illegal messaging;
- Spreading ethnically, racially, or otherwise objectionable information;
- Spreading religious or cultural intolerance;
- Sexually explicit, libellous, harassing, defamatory, abusive, profane, vulgar, threatening, hateful, obscene behaviour and terrorism-related content;
- Advertising or encouraging the use of tobacco, alcohol, and any illegal substances;
- Copying, distributing, renting, reselling, modifying, compromising, damaging, disabling, impairing, and overburdening Class Hud;
- Interfering with or abusing other users of Class Hud;
- Using bots, scripts, and other automated methods; and
- Collecting and disclosing any information about other users of Class Hud.
MARKETING AND INFORMATIONAL NOTICES
Marketing messages : To keep the users up-to-date with Class Hud, we may the users marketing messages, such as newsletters, brochures, promotions and advertisements, informing the users about our new services or new features of Class Hud. We will contact users for marketing purposes only if:- We receive user's express ("opt-in") consent to receive marketing messages; or
- We decide to send the Organizations marketing messages about our new services that are closely related to the services already used by the Organizations.
SECURITY
We take appropriate security measures to protect the information we store on Class Hud against unauthorised access. The security measures taken by us include secured networks (we use SSL encryption), strong passwords, DDOS mitigation, limited access to personal data by our staff, and anonymisation of personal data (when possible). Avoiding phishing and scam : Phishing is an online scam that aims to trick someone into giving up their personal data, such as credit card numbers, social security/national ID numbers, or other financial data. Usually, when scammers have that information, they will then use it to steal your money, property or identity. The user agrees not to disclose any financial information through Class Hud or make any transfers to other users of Class Hud or third parties outside Class Hud with regard to Class Hud, unless it is required (i) to process user's payment or (ii) other legitimate purposes within the scope of the services provided through Class Hud. The user is solely responsible for the interactions with other users of Class Hud. The user acknowledges and agrees that we do not conduct any checks of the qualifications, certification, skills, and background of Class Hud users. We make no representations or warranties as to the conduct of Class Hud users. Security incidents : Given the nature of communications and information processing technology and the Internet, we cannot be liable for any security incidents, cyber attacks, data breaches, and unlawful destruction, loss, use, copying, modification, leakage, and falsification of any information caused by circumstances that are beyond our reasonable control.INTELLECTUAL PROPERTY
Our Content : Most of the content made available on Class Hud excluding the Records, is owned by us, our partners, agents, licensors, vendors, and/or other content providers ("Our Content"). Our Content includes, but is not limited to, text, images, audio-visual content, source code, trademarks, service marks and trade names. Our Content is protected by the applicable intellectual property laws and international treaties. The user is not allowed, without obtaining prior written authorisation from us, to:- Copy, distribute, and make available Our Content to third parties;
- Disassemble, make alterations, decompile, reverse engineer, translate, and adapt Our Content;
- Distribute, rent, loan, use, lease or attempt to grant other rights to Our Content to third parties; and
- Use any manual or automated means to scrap any content available on Class Hud.
AVAILABILITY AND FORCE MAJEURE
Availability : We put reason able efforts to ensure that Class Hud is always accessible. However, the availability of Class Hud may be affected by factors, which we cannot reasonably control, such as bandwidth problems, equipment failure, acts and omissions of our third-party service providers, or force majeure events. We take no responsibility for the unavailability of Class Hud caused by such factors. Force majeure : The Company is not responsible for the unavailability of Class Hud due to the circumstances outside Company's reasonable control and force majeure events, including, but not limited to: acts of God; strikes; work stoppages; accidents; acts of war or terrorism; civil or military disturbances; nuclear or natural catastrophes and interruptions; and shortage of supply, breakdowns.DISCLAIMER OF WARRANTIES
We provide Class Hud on "as available", "as is", and "with all faults" basis. To the extent permitted by the applicable law, we do not make any representations or warranties about the reliability, suitability, and accuracy, for any purpose, of Class Hud, any content featured on Class Hud, whether provider by us or by third parties, and hereby disclaim all warranties regarding Class Hud and its operation. It is user's sole responsibility to verify and assess the fit for the purpose of Class Hud prior to using it and to decide whether or not Class Hud fits for the intended use. By using Class Hud, the user acknowledges that we may use third-party suppliers to provide software, hardware, storage, networking, and other technological services. The acts and omissions of third-party suppliers may be outside of our reasonable control. To the maximum extent permitted by law, we exclude any liability for any loss or damage resulting from the acts and omissions of such third-party suppliers. Nothing in these Terms shall affect any statutory rights the user is entitled to as a consumer and that the user cannot contractually agree to alter or waive.LIMITATION OF LIABILITY
Unless otherwise excluded or limited by the applicable law, we will not be liable for any damages, including, but not limited to, incidental, punitive, special or other related damages, arising out or in connection with user's use of Class Hud, any content made available through Class Hud, whether provided by us or by third parties, or any transactions concluded outside Class Hud or as a result of Class Hud. The user agrees not to hold us liable in respect of any losses arising out of any event or events beyond our reasonable control. We will not be liable to the user for any direct, indirect or consequential losses, which may be incurred by the user in relation to Class Hud, such as:- Any health issues, cases of injuries and death experienced as a result of the use of Class Hud;
- Direct and indirect loss of profits;
- Loss of goodwill or business reputation;
- Loss of opportunities; and
- Loss of data suffered by the user.
- Any changes which we may make to Class Hud, or for any permanent or temporary cessation in the provision of Class Hud or any features thereof;
- The deletion of, corruption of, or failure to store the User-Generated Content and other data maintained or transmitted by or through Class Hud;
- User's failure to provide us with accurate personal data;
- Communication, business or personal relationships between the users and the Suppliers; or
- Any reliance placed by the user on the completeness, accuracy or existence of any content, information, recommendations, or advertising featured on Class Hud, or as a result of any relationship or transaction between the users, advertisers, and other third parties whose content is featured on Class Hud.
INDEMNIFICATION
The user agrees to indemnify, defend and hold the Company, its subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including attorneys' fees, made by any third party due to or arising out of your breach of these Terms, user's use of Class Hud, or user's violation of any law or the rights of a third party.SEVERABILITY
In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such a provision shall nonetheless be enforceable to the fullest extent permitted by the applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. The validity and enforceability of the remaining provisions shall not be affected as a result.GOVERNING LAW
Governing law : These Terms shall be governed and construed in accordance with the laws of INDIA and Jurisdiction under Ludhiana Punjab.MISCELLANEOUS
Term and Termination : The Terms enter into force on the date indicated at the top of the Terms and remain in force until updated or terminated by us or until the user stops using Class Hud. Amendments : We reserve the right to modify these Terms at any time, effective upon posting of an updated version on Class Hud. Such amendments may be necessary due to the changes in the requirements of laws, regulations, new features of Class Hud, and our business practices. We will send the users a notification (if we have their email addresses) about any material amendments to the Terms that may be of importance. User's continued use of Class Hud after any changes shall constitute user's consent to such changes. We also reserve the right to modify the services provided through Class Hud at any time, at our sole discretion. Breach of the Terms : If we believe, at our sole discretion, that the user violates these Terms and it is appropriate, necessary or desirable to do so, we may:- Send a formal warning;
- Suspend or terminate the Account;
- Temporarily or permanently prohibit the use of Class Hud;
- Report the user to the relevant public authorities; or
- Commence a legal action against the user.
